Authorizer's Certificate for Short Term Loans

As a condition to receiving an authorizer’s certificate from the Bay Mills Charter School Office (BMCSO) for any short-term loan or state aid note borrowing, an academy must certify, in writing, to BMCSO that: (i) as of the close of the most recent fiscal year, the academy has no outstanding unpaid management fees; (ii)the academy has no outstanding and/or unpaid loans, or any other indebtedness that is not disclosed as a permissable debt in its annual financial audit; (iii) the academy has no hidden or off-book debts, loans, or other indebtedness; An academy that fails to provide the written certification above, or that fails to disclose all non-compliance with the above certification provisions, will not receive an authorizer certificate from BMCSO. Recently there has been interest by some schools to provide “shared time” services to local private schools. Please be advised that in all similar circumstances it is incumbent upon academy boards to first establish the legality of any proposal outside its current charter with Bay Mills Community College. In other words, it is expected that all proposals such as shared time, expansion of grade levels, change of locations, long term financing, or any other matter could potentially result in an amendment to the charter document must first be reviewed by the academy board, the board’s attorney and then submitted in a letter, including legal opinion, to Erin Forrester, Compliance Coordinator, Bay Mills Community College.
